The answers to all these questions can be found in a new document - Administrative regulations on the provision of public services for the conduct of medical and social expertise.

Registration of disability, passing the procedure of medical and social examination is an occupation that often takes a lot of time and effort from a citizen. The new administrative regulations are, in fact, a kind - and very detailed - "instruction" on how, ideally, the certification procedure should proceed.

1 What is the time frame for the examination?

The maximum allowable time is 30 calendar days from the date of application submission. Moreover, this period also includes the time for an additional survey, if such is required during the ITU. The application must be recorded in the Incoming Log on the day it is submitted. In a maximum of five days, an invitation for an examination is sent to the citizen, which indicates the address, date, time and office number. If the citizen wishes, the invitation can be sent to him by e-mail.

The date and time of the survey are set in such a way that the waiting time in the queue does not exceed 30 minutes.

Important: You can apply without attaching the necessary documents. In order to "convey" them, 10 calendar days are given.

2 How to find out about the results of the examination?

The decision of the bureau (as well as the main and federal bureaus) to establish a disability, determine the degree of disability, etc. is adopted by a simple majority of votes of specialists included in the commission for the survey. The result with all the necessary explanations is announced to the person immediately.

If the examination was carried out in absentia, the decision and the necessary explanations can be obtained in writing or by e-mail. The letter, signed by the head of the bureau and certified by the seal, is sent no later than three days after the decision is made. The e-mail is certified with an electronic signature and sent through a single portal of state and municipal services. The term is also three days.

3 How to appeal an ITU decision?

If a person does not agree with the results of the examination, he has the right to write a statement of appeal against the decision to the same office where the examination took place. The bureau itself, within 3 days from the date of receipt of the application, sends it with all the available documents to the main bureau. There, within a month, a new medical and social examination is carried out and a decision is made.

The same principle applies when appealing against the decision of the head office. The application submitted there, along with the documents, is sent to the federal bureau, and the final decision is made within a month.

Important: In the application for appealing the decision of the bureau, the surname, name, patronymic of the applicant, his address, the essence of disagreement with the decision of the ITU, please conduct a new examination of the appeal. At the same time, the reduction of words and the use of abbreviations are not allowed.

4 Who oversees the work of the ITU Bureau?

Roszdravnadzor is responsible for overseeing the work of ITU. This federal service conducts planned and unscheduled inspections based on complaints received from citizens or organizations.

5 Can they charge money, for example, for completing an additional examination?

All ITU Bureau services are free of charge.

6 How should the work of the bureau be organized to make it easier for people with disabilities?

ITU offices should be located primarily on the lower floors of buildings and be accessible to wheelchair users (wide doors, ramps, etc.). Parking is provided near the office building, including for disabled cars. Wardrobe, toilet are equipped so that it is convenient for disabled people to use them.

In order to streamline the queue, the document recommends, if possible, to install electronic queue control devices in the office premises, as well as light boards, which will reflect the order of the ITU passage.

All addresses with telephone numbers are attached to the administrative regulations. If a citizen asks a question by phone, the specialist who received the call is obliged to name his bureau, his last name, first name, patronymic, position and answer questions.

Administrative regulations are a consolidated document that summarizes the entire extensive regulatory framework for medical and social expertise. Naturally, it is difficult for an ordinary citizen to find all these documents, get acquainted with them and take them into account. The administrative regulations prescribe the general procedure for the work of medical and social expertise in a simple, clear and accessible language. In practice, these are the rules for the provision of public services for conducting ITU, which are mandatory for specialists. Important! The decision made by the commission is communicated to the patient on the same day on which the examination took place. In the case of a positive conclusion, the person is handed the original of the certificate, as well as a scheme for future rehabilitation and treatment developed specially for him.

An appeal of a citizen with this very certificate to a pension fund or other social organization to receive a pension and other assistance. This must be done within three days after receiving the papers.

In total, in about two months it is really possible to successfully obtain a disability.

However, this does not mean that the visit to the ITU Bureau can be forgotten. Depending on the assigned group, disabled people in Russia must confirm their status at regular intervals:

  • the first group - every two years;
  • the second and third - annually;
  • disabled children - once during the duration of this status.

Before the deadline is also possible. If this is associated with a noticeable deterioration in the condition of the citizen - then whenever you like, if not - then the disability should be valid for no more than two months.

Decree of the Government of the Russian Federation of 20.02.2006 N95 provides citizens with the right to challenge the decision of the commission. There is a one month deadline for the local ITU center in the main office. The same period applies for a complaint against a decision of the main bureau in the federal center.

In this case, the documents for appeal must be brought to the office where you have already been examined. It is it who itself is forced to transfer the applications of dissatisfied citizens to higher authorities within no more than three days. The very last body that can be contacted in such proceedings, and whose decision is no longer subject to appeal, is the court.

Possible difficulties

  • The patient himself is in a non-transportable state or in intensive care. Then the doctors of the medical institution, his relatives and the company in which the patient is employed are obliged to collect papers. His collected documents are transferred to the ITU bureau on the basis of a special certificate confirming the inability of the citizen to deal with everything personally.
  • The clinic in which the patient is located is psychiatric, and the situation is similar to the previous one, that is, the person's condition is very difficult. At such moments, a notarized power of attorney is usually drawn up, and his relatives have the right to speak on behalf of the patient.
  • A citizen is able to independently deal with the registration of disability, but in a medical institution he was refused a referral. The solution to this problem is to request a form in the form

ITU or medical and social expertise exists to perform certain tasks, in particular, conducting an examination, assigning a disability group, assessing the current state of health and further prognosis.

ITU experts should establish the need of a potential disabled person for social protection and rehabilitation, based on the criteria approved in Art. 7 and 8 of the Federal Law No. 181 of November 24, 1995 "On the social protection of disabled people in the Russian Federation."

This law also characterizes the ITU examination as the process of assigning an appropriate status to an applicant, taking into account the degree of disability and not only. Next, we answer the most pressing questions within the topic.

What are the tasks of the ITU Bureau?

So, in total, 5 key tasks can be distinguished (some of them are briefly spelled out above and will be disclosed):

1) Establishment of disability - for this, doctors must check the compliance of the restrictions with the specified criteria, in other words, disabled persons are considered those who have persistent health disorders provoked by injuries, defects or diseases, and the ability to serve themselves is not fully manifested or is lost (the same regarding communication, doing work, etc.).

2) Development of an IPR for a disabled person (individual rehabilitation program) - we are talking about a specially developed document that contains a set of measures to compensate or restore the lost abilities of the body, plus, the program may indicate the tasks and goals of the expected results with possible consequences and much more (for example , the opportunity to study and work with recommendations).

3) Determination of the disability group - here we mean such categories as 1, 2 and 3 disability groups and separately "disabled child". In any case, the severity of violations plays a key role, based on which a specific group is assigned (for example, group 1 indicates severe restrictions).

4) Re-examination - it is necessary to confirm (renew) disability for groups 2 and 3 every year, and for group 1 - once every few years, unless, of course, the status has been assigned for life. Children with disabilities can be examined once a year or several years until they reach adulthood, then the process is repeated and it is likely that the group will be given indefinitely (especially in the absence of positive dynamics).

5) Identification of the causes of death of persons with disabilities - to use this service, one of the family members of a deceased person with disabilities must write an application, attaching a package of documents (passport, copies of death certificates and certificates of disability, an extract from the pathologist's examination card). As a result, an expert opinion is formed (it has an electronic or paper form).

Who oversees the work of the ITU Bureau?

The inspection (including unscheduled) and control of the ITU activities are carried out by representatives of the Federal Service of Roszdravnadzor.

What do ITU institutions include?

Clause 1 of the Procedure approved by Order of the Ministry of Labor No. 310n of 11.10.2012 indicates that the ITU hierarchical system includes:

The Federal Bureau of Medical and Social Expertise (FB MSE) is the central body that controls the bureau of a lower level, which, if necessary, carries out an examination (if the case is complex, special or a disabled person wants to appeal a previously made medical decision) and training of specialists in this profile (including advanced training);

The main ITU bureaus in the regions (ITU GB) - operate within a certain constituent entity of the country, can revise the conclusions issued by local bureaus and accept new ones, assess the applicant's health by creating a special expert staff;

Main bureau of ITU FMBA (here residents of certain territories and employees of certain sectors of industry with special working conditions are examined);

Local ITU bureaus (their number is calculated depending on the number of the local population), that is, located in settlements and representing branches - this is where any survey begins.

By the way, in addition to the above, there are bureaus in which work regarding the establishment of disability is carried out on one of the diseases (tuberculosis, visual and mental defects, etc.).

How does ITU differ from VTEK?

Medical and social expertise has been operating in Russia for over 20 years, while some citizens still do not understand the difference between ITU and VTEK. The fact is that the second abbreviation designates the medical and labor expert commission, which has been operating in the country since 1929. Here, too, they were engaged in the assignment of disabilities and the appointment of rehabilitation measures for persons with disabilities.

But in 1995, in accordance with the adopted Federal Law No. 181, the functions of the liquidated organization were transferred to ITU. By and large, the ITU has only minor differences in the areas of activity carried out by VTEK (the same can be said about the organizational structure). Moreover, the current ITUs operate in the premises previously provided for the WTEK.

Where is ITU held?

According to paragraph 20 of the Rules, approved. By Government Decision No. 95 of 20.02.2006, the applicant undergoes a medical examination at the place of residence or stay. If the case is exceptional, that is, the recipient of the group is not able to visit the bureau himself, experts go to his home. And if the rehabilitation program conducted for a disabled person does not change the health side of improvement, the disability can be extended in absentia (it is not necessary to appear for an examination).

Also, addresses with telephone numbers are indicated in the annex to the administrative regulations. It should be borne in mind that when conducting a conversation on the phone, the specialist who received the call must indicate his full name, position and bureau.

How should ITU's work be organized for the convenience of the disabled person?

Ideally, when the office is located on the ground floor of the building and is accessible for disabled people who use a wheelchair (for example, ramps, wide doors, etc. are needed). It is also important that there is a parking lot near the building (including for people with a disability group). Toilet, cloakroom should be equipped so that it is convenient for a person with disabilities to use them. Electronic queue control devices and light boards reflecting the order of passage of the ITU will not interfere.

Who is on the ITU Commission?

Focusing on clause 4 of the Order, approved. By order of the Ministry of Labor No. 310n of 11.10.2012, it is possible to find out that the experts of a particular bureau (where the applicant applied) are engaged in the examination. The commission should consist of three doctors and other professionals, if necessary (rehabilitation specialists, psychologists, etc.).

If the situation so requires, experts on adaptation and social work are included in the commission, and for the implementation of the additional survey program within the ITU, they may additionally invite specialists of a narrow profile.

Be that as it may, according to GOST R 55635-2013, the requirements for all participating experts are approximately the same. For example, it is obligatory for them to have specialized education and knowledge concerning the basics of healthcare legislation, about ITU, about the international classification of disabilities (ICF). The experience of the practice of conducting ITU (including international) will not hurt.

A specialist in the commission must be able to draw up a rehabilitation prognosis and assess the patient's rehabilitation potential, as well as possess ethical skills, have an idea of \u200b\u200bsafety precautions and be ready to perform the necessary functions that do not go beyond the competence.

What is the order of ITU passage?

This issue is governed by the Rules, approved. Government Decree No. 95 of 20.02.2006, which sets out the general procedure for passing the examination. This refers to the following key steps:

A potential disabled person, having in his hands all possible evidence of his ill health, receives a referral to the ITU from his doctor, from the Pension Fund or from the social protection authorities;

Directly at the expert bureau, an application for passing the examination is drawn up and signed, a package of documents is submitted;

The representatives of the commission appoint a date for assessing the applicant's condition by sending him an invitation indicating the place and time;

On the appointed day, an examination takes place, the information provided is studied (from medical documents to social status, etc.);

As a result, a protocol is drawn up, an act is written with the adopted decision (the majority of votes are taken into account), which is announced to the recipient of the group;

In case of recognition of the status, they issue a certificate of disability and develop an IPR ( individual program rehabilitation).

What documents are needed to pass the examination?

The package of submitted documents includes:

Applicant's passport (or birth certificate for children under 14);

Referral to ITU (form 088 / u-06);

Proof of the authority of the legal representative, if he acts on behalf of a person with disabilities (certified power of attorney);

Statement stating the request to carry out the survey;

Extract from the outpatient card and all medical data related to the current condition.

Additionally, certificates of occupational disease or accidents at work may be required, if this has taken place. Plus, working people with disabilities attach a description of the place of work and working conditions.

What is the time frame for the examination?

A maximum of 30 days can pass from the date of application, and the fact of registration is recorded in a special journal. During this time, according to the rules, an examination is carried out (if necessary) and an examination is carried out (by the way, the time is appointed in such a way that you do not have to wait in line for more than half an hour).

Most often, an invitation for an examination in paper or electronic form is received by a citizen with a disability within 5 days from the date of submission of the application and documentation (papers can be submitted not immediately, but no later than 10 calendar days, starting from the date of the request).

How to find out about the results of the examination?

A decision on the purpose of disability and the degree of restrictions is made by taking into account the majority of the votes of the commission members. The results and the necessary explanations, as noted above, are presented to the applicant for the group on the spot. It is also possible to send a letter by e-mail through the State Services portal. In any case, the document is signed by the head of the bureau, stamped and sent to the applicant within three days from the date of the decision.

Do they charge money, for example, for completing an additional examination?

There is no need to pay for the services provided by the ITU Bureau. The entire certification process is free.

How to appeal against an ITU decision?

If you disagree with the results, you can apply to the same office where the examination took place. From here, the appeal request and the package of documents will be sent to the main office within 3 days. Then a re-examination will take place within one month.

If the decision does not suit you again, you need to act according to the principle described earlier, only this time the application from the main one is forwarded to the federal bureau. The maximum term for making a decision is also 30 days.

Finally, the court is the last resort where you can express your disagreement with the opinion of the expert committee on disability. By filing a claim within 3 days from the date of receipt of the ITU decision, the applicant has the right to insist on the involvement of independent specialists.

Important: a statement of appeal (without abbreviations and abbreviations of words) must include the name and address of the applicant, as well as the essence of his disagreement and the request for a new examination.

The innovation of the Ministry of Labor of Russia, which approved new classifications and criteria, should primarily reassure the patients of the ITU Bureau - people with disabilities... Some of them often expressed dissatisfaction and complained about the incorrectness of the disability groups assigned to them, explaining this by the subjectivity of specialists.

After all, disability in general and its group, in particular, for our people have essential, since they give certain social guarantees of state support: that a person with disabilities receives instead of benefits in kind canceled ten years ago, as well as the opportunity to use, travel, and so on.

The degree of disability is determined as a percentage

Until recently, specialists in carrying out medical and social expertise were guided by scattered recommendations and instructions. That to some extent contributed to the "discrepancy" about the assignment or refusal to establish disability, "understatement" of the group, and so on. To exclude this, at the end of last year, the Ministry of Labor of Russia developed clear, uniform for all regions quantitative indicators for assessing the severity of violations of the functions of the human body (respiration, blood circulation, digestion, and so on). This made it possible to eliminate the subjectivism of experts during the examination.

At the same time, it should be noted that there is no significant difference in approaches to establishing disability then and today. As in the previous document, the new one is based on the severity of functional impairment due to disease, injury or defect. But only now - as a percentage.

There are 4 degrees of persistent disorders of the body's functions:

I degree - given with minor violations of body functions in the range from 10 to 30%;

II degree - with persistent moderate disorders of body functions in the range from 40 to 60%;

III degree - with pronounced disorders of body functions in the range from 70 to 80%;

IV degree - with persistent, significantly pronounced disorders of body functions in the range from 90 to 100%.

In order, again, to avoid the subjectivity of specialists when determining a quantitative assessment in percent, a corresponding document was published (annex to the classification). In it, as a percentage, the clinical and functional characteristics of persistent disorders of the functions of the human body are stated.

A few more key points

Even if there is no specific disease in the application, experts will consider a general approach to the class of diseases.

If there are several persistent disorders of the body's functions, each of them will be assessed separately. And then they will select the maximum violation expressed as a percentage.

In the event that the fact of the influence of other violations on the weighting of the maximum violation of the body's function expressed in percentage is established, then it can be increased, but not more than by 10%.

The third group of disability is assigned in a new way

The ITU Bureau also drew attention to the fact that for the establishment of disability groups, the classifications of the main categories of life activity and the criteria remained the same, except for group III. If earlier it was possible to get III group of disability, having only one limitation of life activity of the first degree, now two or more are needed.
